Procedure for Adopting New Rules in California HOAs

Hi Ronald,

As per the Davis-Stirling Act, the procedure for adopting new rules are as follows:

1. Board prepares rules and legal counsel review them (or attorney prepares rules).
2. Board reviews, approves and gives general notice (we recommend mailing) to members. Notice should include purpose and effect, text of rules and set a deadline for written comments at least 28 days later. Notice should also set an open meeting at least 28 days later.
3. At open meeting, allow more comments at open forum. Consider all comments. Vote to approve or not.
4. Give notice of approval within 15 days.
