Refusing to Join New HOA in Ohio

Question:

Hello, I have lived in my neighborhood for 12 years. At that time, I was the only person living in the neighborhood. Since then, all of the lots have been purchased and there are neighbors that now want to start an HOA. I am not required by law to join, correct? Thank you.

Answer:

Hi Ashley,

Typically, you can refuse to join an HOA if you purchased your home prior to the creation of the HOA. However, it would help to ask an attorney to look through your deed and deed restrictions to see if there is anything you missed.
