Removing Planters on Property

Question:

For two years I tried to get my HOA Board help me with the owner that lived below me. He was a felon and meth addict that fell off the wagon. Strange smells, strange people in and out all night, garbage piled outside up to five feet high in front of the unit below me and even in back. Flies, rats….you name it. My final straw was when I saw the President and Treasurer helping to move his untagged vehicle into another spot after everyone received tow notices because work was being done. I got a lawyer. Soon after his unit was sold by the bank. Now a few years later and this same HOA Board is using the Property Manager to make us remove even planters on our decks or out front. Mainly it is two members that are being picked on. What can I do? They are sending threatening emails.

Kindly review the governing documents to verify whether planters on the decks or out front are against the HOA’s rules. If they are, then the board may be authorized to enforce this rule on the homeowners. Otherwise, you may raise this with the HOA board. If the board members are behaving in a threatening manner, it may be wise to resolve the issue by speaking with the board members directly. If that does not work, you may also use dispute resolution measures to resolve the problem. As a last resort, you may opt to remove the problem board member(s) according to the provisions in the governing documents.
