Removing Security Without a Vote in Virginia HOA

Question:

I reside in a 55+ POA gated community. The community board unilaterally, without public notification or discussion eliminated the overnight security at our entry gate by simply “removing it from the budget.” It is my understanding that any amenity listed in the disclosure packet residents receive upon purchasing a property, can not be removed without a vote of the community. Please advise if I am right, or who I should contact to question this.

Answer:

Hi Bruce,

A homeowners association can generally adjust the budget according to the needs of the community. It is currently not required for an HOA to conduct a vote to remove an item from the budget.
