Rental Restrictions for HOAs in Louisiana

Question:

Working with our HOA. They asked me to research if our HOA can prohibit rentals in our neighborhood. If that’s not possible, can a cap be placed on the number of rentals allowed in the neighborhood at one time? Can we place a minimum amount if time the rental must last – such as 1 year? Should we ask home owners to include that renters must abide by HOA restrictions or face fines? How do we add restrictions for renting? A amendment or somewhere else? Thank you. What do you recommend.

Answer:

Hi Nancy,

Homeowners associations are generally permitted to impose rental restrictions in Louisiana. However, you must make sure that these restrictions are included in your governing documents, specifically your CC&Rs. Your CC&Rs must reflect the exact restrictions you want to place, including rental caps, minimum duration of rentals, and other rules. You will likely need to amend your CC&Rs to reflect these changes. For amendments, it is best to consult an attorney.
