Requesting to See RFPs in Minnesota HOA

Question:

I want to obtain copies of all RFP’s sent out for a $6millionn project the asssociation is putting upon the homeowners. I doubt due diligence has been done. Also, I believe this documentation is available to homeowners upon request. Do you know where I would find that information such as declaration or bylaws?
Does MN Statutes override bylaws of an HOA?

Answer:

Hi Deeann,

Section 515B.3-118 of the Minnesota Common Interest Ownership Act gives homeowners the right to request association records, including “records of its membership, unit owners meetings, board of directors meetings, committee meetings, contracts, leases and other agreements to which the association is a party, and material correspondence and memoranda relating to its operations.” The only records a homeowner may not examine are those “relating to information that was the basis for closing a board meeting under section 515B.3-103.”

You may request these records, as well as the declaration or bylaws, from your HOA board or manager.
