Response Time of ARC in Maryland HOA

Question:

Hello, my wife and I are building a deck on our home, and we’ve submitted a request to build to our HOA (SFMC Maryland). Their “ARC team”, goes through a review process on the 13th of each month. They’ve been unresponsive the last three days (including today). We expressed to our HOA a timeframe we needed to operate within because of an upcoming event at our home. The deck is consistent with our neighborhood’s other decks (materials, size, construction) which is prompting our concern, considering their lack of response. Can something be elevated or done to help us get an answer? Our builder has the permit and is waiting on our HOA. Voicemails and email communication have all been ineffective.

Answer:

Hi Alexander,

In Maryland, there is no specific time frame mandated by state law for an HOA’s Architectural Review Committee (ARC) to respond to a homeowner’s request. However, it’s common for HOAs to establish their own guidelines regarding response times. To get the most accurate information, check your HOA’s governing documents, including the architectural guidelines. These documents typically outline the specific procedures and timelines for the ARC’s review process.
