Revoking Member Privileges in Maryland HOA

Question:

Is it against the law for a HOA to withhold parking privileges to residents who are delinquent on HOA fees?

Ex: not reissue all( suppose to get 4 but only will get 2) parking passes to a resident who is behind on fees. Once the reside is caught up on delinquent fees, they will be able to gain access to all 4 passes.

Answer:

Hi Marcellina,

Maryland law currently does not restrict this. It is common for homeowners associations to temporarily revoke a member’s privileges as a penalty for late payments. That being said, make sure your governing documents allow you to take such an action.
