Right to HOA Financial Reports in Pennsylvania

Question:

I live in a planned community in Blandon Pa., with a nonprofit HOA. We pay $800 dues annually. Within the last year a board member misappropriated approximately $4k as a personal gain to himself. I became concerned. Do we as homeowners have a right for copies of the financial report.

Hi Ron,

According to Section 5316(a) of the Pennsylvania Uniform Planned Community Act, “The association shall keep financial records sufficiently detailed to enable the association to comply with section 5407 (relating to resales of units). All financial and other records shall be made reasonably available for examination by any unit owner and authorized agents.”

Your governing documents should tell you the right procedure for requesting such documents for examination. If you believe a crime has been committed, it is important to report the incident to the police department.
