Rights of Homeowners Regarding HOA Complaints on Architectural Changes

Question:

What are my rights after painting an outside wooden rails very close to the same color and than 10 months later receiving a letter saying the color does not match

– Stephen

Answer:

Hi Stephen,

Kindly refer to your HOA’s governing documents and review what outlines they have set regarding architectural standards homeowners must abide by. Depending on what’s written, you may be obligated to change the color.

Apart from this, homeowners have the right to due process as outlined in the governing documents. Typically, HOAs may need to issue a warning letter before they can issue fines for architectural change violations. They may also need to give homeowners an opportunity to handle the problem through dispute resolution. If they request a hearing, they may need to inform homeowners ahead of time and provide the location and time.
