If an HOA in N.C. has not established governing rules and regulations, can the Board of Directors establish and adopt a set of rules and regulations without the approval of the property owners?

Hi Andrew,
It depends on whether or not the adopted rules significantly alter the CC&Rs and bylaws or if they’re more restrictive than the existing guidelines. If so, the rule additions and changes may require a vote from the community. However, minor operating rules and regulations can generally be adopted without a vote. But, they cannot be in conflict with the other governing documents.
