Rules for Executive Session for Condo Board

Question:

What are the rules for the condo board going into Executive (closed) Session? Are there limited reasons to go into Executive Session? What is the proper (generally accepted best practice) for going into Executive Session?
Pls LMK. Thank you.

Answer:

Hi Jerry,

Wisconsin law currently does not address condo board executive sessions, so it depends on your governing documents. Your bylaws should tell you how and when to conduct closed/executive session meetings, including any notice requirements. Typically, condo boards go into executive session to discuss confidential or sensitive issues, such as disciplinary hearings, ongoing litigation, personnel issues, and delinquent accounts. You can either do this before or after a regular board meeting, depending on your bylaws.
