Running a Home Business in Arizona

Question:

I am on the board of directors in our small community in Mesa AZ. We have renters who seem to be running some sort of furniture business from their home. Constantly loading up what seems to be the same furniture and driving off with it. We attempt to contact the management company but they do not respond. Sent emails and finally have started to fine them.
My question is how do you deal with unresponsive management companies? Neighbors notice it and complain. Talked to the police because they at times leave their loaded trailer in the community but they can not do much but talk to the people. Do they need a license to conduct this type of business? Our CC&R’s forbid no running a business from your home.
What advice can you give as how to handle this.
We also self manage our HOA.

Hi Kathleen,

If your HOA’s governing documents prohibit home businesses, it is important to follow the enforcement procedures laid out in your CC&Rs. Normally, this would mean sending the homeowner a violation letter, giving them an opportunity to be heard, and imposing disciplinary action (such as fines). Make sure to contact the homeowner whose home is being used to run a business. If your HOA board is not responding to emails, it may be worth calling them or approaching them in person.
