Secret Ballot Voting in Florida HOAs

Question:

We are having our HOA meeting in our community on November 30. We have been involved with HOAs for 30 years, and have always received a ballot, a proxy, and the specific envelopes to place the ballot and proxy into prior to each election. In our current community, they simply gave us a ballot and proxy to use with no further instruction. Is this legal? It seems a privacy issue has been neglected. Thank you in advance.

Hi Anna,

It seems that your previous HOA communities utilized secret ballots for voting. Some HOAs don’t do secret ballots and, therefore, don’t need the voters’ identities to be kept secret. Make sure to check the governing documents of your current HOA to know whether secret ballots are required or not. You may also ask the HOA board for guidance.
