Seller Failed to Disclose Damage to Buyer in HOA

Question:

I live in an association- that raised its monthly dues from 326 to 350/ month. The association has poor exterior maintenance. But beyond that. I bought my house roughly a year ago. I believe this week will be a year. The seller did not disclose structural damage at the sale of the house- Otherwise, I wouldn’t have moved forward with the purchase had I know that the association would tack on a $30,000.00 debt to my fees to repair my unit’s deck. How can a board agree to put me in a debt that large without my approval? I can not afford this extra payment of $336 (roughly) a month. Like most American’s I live paycheck to paycheck. I have a full-time job that pays well, I clean house, and starting another side job next month through the summer. I have medical issues that I need to address that all takes backburner because of this decision. Can they just do that? Is there anything I have that can protect me legally? Is there any legal stance that I have? Is there any resources or help?

Hi Elizabeth,

This is largely an issue between you and the seller/previous owner of the home. If the seller knew about the structural damage to the home and failed to disclose it, they may be liable for damages. Consult an attorney for further guidance.
