Short-Term Rental Fee in Oregon HOA

Question:

Can a condo HOA in Oregon start charging short term rental owners a $35 fee per short term rental occupant? Short term rental owners are allowed in this HOA, but they are trying to discourage it and think there is more damage caused by short term renters.

Hi Lori,

Generally, an HOA/condo can charge a fee for short-term rentals in Oregon but this should be outlined within your governing documents. If your CC&Rs don’t contain this provision, then your HOA board may not have the authority to charge this fee. Other ways an HOA can restrict short-term rentals is by placing a cap on the number of units that may be renter-occupied.
