Submitting Proxy Requirements After the Deadline

If an owner missed the deadline to have proxy requests submitted with the annual meeting documents, can they post such requests on the community bulletin board?

Answer:

Hi Jeri,

According to the Hawaii Planned Community Associations Section 421J-4(c), to be valid, proxies shall:

  • Be delivered to the secretary of the association or the managing agent, if any, no later than 4:30 p.m. on the second business day prior to the date of the meeting to which it pertains; and
  • Contain at least the name of the association, the date of the meeting of the association, the printed name and signature of the person or persons giving the proxy, the unit or units for which the proxy is given, and the date that the proxy is given.

That said, you may deliver the proxy request to the secretary on the second business day before the meeting date by 4:30 p.m. Kindly also review the governing documents or ask the board to verify whether there are other provisions or requirements for submitting proxy requests.
