Switching Vendors Without a Vote in IL

The Board has decided to change vendors (AT&T for Comcast) The assessment includes our payment to the vendor as well as the management fee. They decided to drop AT&T without notice to the homeowners and did not have a contract with Comcast. We have all received bills for services that the association was to have paid. They told us to forward the bills to them and now they are refusing to pay them putting the payment on the homeowners as well as keeping the assessments. Since we were unaware they did not pay we now have 2 months of payments with over $600.00. And there is still no contract for services with Comcast.
Please advised if we need to pay twice.

The HOA board generally has the authority to switch vendors even without securing a vote from the membership unless your governing documents say otherwise. That said, the HOA should have a contract in place with a vendor to protect the association from potential liability.

Check your governing documents to see if individual homeowners are responsible for paying such utilities or if the HOA is responsible for it. Additionally, you may request certain records from the association, such as financial reports, to see where your money is going.
