Term Limits for HOA Boards in California

Does the California Law stating that a board member can only serve two consecutive terms and must sit out a year supersede a HOA bylaw that does not state a term limit for board members?

Hi Aaron,

There are no term limits for HOA board directors under California law. According to theĀ Davis-Stirling Act, “If there are no term limits in an association’s governing documents, directors can be elected and re-elected to the board until they cease to be qualified to serve on the board.”
