Texas HOA Board Not Enforcing Parking Rules

Question:

We have a restriction that states a vehicle cannot be left in a driveway or in the street for a given period of time (to be detremined by the board) if so it falls under being a nuisance, I’ve had a vehicle parked next door to me and it has not moved in over a year and the HOA will do nothing, I have written them I have called them I’ve spoke and written to our MGMT Co and no help from no one….
What can I do? I’m retired and don’t have the money for a lawyer

Hi Anthony,

You may request a meeting with the board or raise the issue at the next board meeting. Kindly also exhaust all forms of communication with the board and management company by contacting them via mail, email, call, and text.

If the board remains unresponsive, you may opt to remove the problem board member(s) according to the procedure outlined in the governing documents. If there is no procedure given, according to the Texas Nonprofit Corporation Act Section 22.211(b), if the director was elected to office, removal requires an affirmative vote equal to the vote necessary to elect the director. For further guidance, kindly consult a lawyer.
