Timeline to Provide Meeting Minutes

Question:

Does a LOA have to provide written minutes of official monthly association board meetings and what is the required time frame for doing that?

– John

Answer:

Hi John,

If the association is organized as a non-profit, according to the Missouri Nonprofit Corporation Act Section 355.826, the association must make records available for inspection and copying to members who have paid into the corporation for services or other charges over fifty percent of the corporation’s operating expenses. The records must be available at a reasonable time and location specified by the association. Moreover, the member must give a written notice or demand five business days before the date they wish to inspect or copy records.

Generally speaking, HOA boards need to make meeting minutes (along with several other association records) available for inspection by the members. The association’s governing documents may also indicate specific provisions regarding meeting minutes, including whether the HOA must send members a copy every month. The timeline should also be outlined there. Kindly review the governing documents for verification.
