Towing Cars in North Carolina HOA

Question:

We have assigned parking, and I double park. However both parks are assigned to me. Recently my vehicle was towed and cost me 200.00 to retrieve. I don’t understand how HOA can do this. I have reviewed the rules and regulations and does not address this. I would think that a written warning is required prior to taking such actions. Please advise, thanks

Answer:

Hi Terry,

Kindly verify whether the towed car was parked on a private or public street. Cars on public streets are generally not under the HOA’s jurisdiction. Apart from this, while it is common practice for HOAs to give notice before towing a vehicle, North Carolina’s HOA laws do not address this specific issue. Regardless, kindly check your mail and other channels of communication with the HOA to verify if they sent a towing notification.

You may also check the governing documents for procedures regarding violations to see if the HOA followed due process. If not, you may raise your concerns and complaints with the HOA board or at the next board meeting. You may also speak with your HOA board to clarify your parking assignments to see if there were any misunderstandings regarding how and where you park.
