Underfunded Reserves for Roof Replacement in Ohio

Question:

I moved from country living to city living to retire. Found a nice house. I did not not ask enough questions about association’s. It’s now three years later and I find its getting harder to get answers to my concerns.
Like why is the funds available to replace roofs so underfunded. One half of the homes were built 22 years ago and need reroofed now. They have not been collecting enough fees for roof replacements for years. What if the board won’t listen to its members?

Hi Ned,

First, it is important to figure out if the HOA is responsible for maintaining the roofs. In condo and townhome communities where the roofs are shared, the association is generally responsible for maintenance, repairs, and replacements. But, in single-family communities, the homeowners are generally responsible.

If you determine that the HOA is responsible for the roofs, you should speak to the HOA board about the issue. Raise your concern that the reserves are underfunded and will not be able to cover the cost of repairs/replacements. If your board refuses to listen or act, you might want to consider removing board members. The process for removing board members should be contained within your bylaws. You may also find guidance under Section 1702.29 of the Ohio Nonprofit Corporation Law.
