Using Ice Melt Over Salt in New Jersey HOA

Question:

I was a Board member a few years ago but my term expired.
My question has to do with using ice melt after a snow storm. The covenants in my community do not allow spreading salt but 20+ years later there is ice melt which does not have the destructive properties of actual salt. Have the laws changed so we can use ice melt?
My concern is if there is snow/ice on the sidewalk and is under 2″ deep and I cannot remove it and the landscaper/snow removal company is not permitted to remove it, and then someone falls on my sidewalk, who is responsible for the damage.

Answer:

Hi Carolyn,

You will have to check your HOA’s covenants to see if there has been an amendment allowing the use of ice melt. Perhaps your covenants need updating to catch up with the modern times. If so, you will likely need to inform your HOA board so they can get the ball rolling.
