Voting Rights of HOA Members With Multiple Units

Question:

The association has 110 units. There is an owner who owns 11 units. Is he entitled to 11 votes?

– Janis

Answer:

Hi Janis,

It depends on the voting rights outlined in your governing documents. Many HOAs will allow one vote per unit. But, it’s best to consult your governing documents regarding this matter. Apart from this, the Connecticut Common Interest Ownership Act Section 47-252(c)(7) states that people with undirected proxies cannot cast votes greater than 15% of the association’s votes, as stated below:

“(7) A person may not cast votes representing more than fifteen per cent of the votes in the association pursuant to undirected proxies.”
