What Insurance Protects the HOA Board?

Question:

We have a volatile owner in our community. We have had multiple violations of community Bylaws. The individual is possibly unstable and takes up a lot of time for Board members.

The individual wants to rent the floating home and places heavy demands on the Board by attempting to skirt the rental agreement bylaws.

Is the Board protected from expensive lawsuits if this individual were to sue the Board?

Is there a type of insurance recommended in the state of Oregon to protect the Board from related lawsuits? jnbangs@yahoo.com or does Oregon Law protect the Board of Directors and owners?

Answer:

Hi C Jean,

Board members are usually protected by the association’s governing documents, though insurance is absolutely necessary. In this case, Directors and Officers (D&O) insurance is a must.
