Who Is Liable for Condo Repairs in CA?

Question:

Part of the wall and flooring inside my condo was damaged by a sprinkler outside my condo. It was directed toward the outside wall of my condo, water seeped in and caused the damage. Am I responsible for paying for the repair inside my condo?

Answer:

Hi Carol,

Generally, the condo association is responsible for maintaining and repairing the common elements, while the owners are responsible for their individual units. However, it is important to check your condo’s governing documents to identify maintenance responsibilities and define common elements. If the damage was caused by someone else’s negligence, they are arguably liable for the cost of the repair, but it will still depend on the situation. It is best to talk to the owner of the sprinkler about the issue.
