Who Is Responsible for Ceiling Cracks in HOA?

My ceiling cracks every winter then the crack close in the summer. Is this considered a cause of the coming from “common area”?

Check your governing documents. Your community map or plat should tell you whether or not the ceiling is a common element or not. Then, check your CC&Rs to see who is responsible for common elements, limited common elements, etc. In single-family homes, ceilings are usually the responsibility of the homeowners. It is also important to investigate the root cause of the cracks in your ceiling to determine who should be responsible. Hire a professional to conduct the inspection.
