Is an exterior deck attached to the building solely the HOA’s responsibility? Many of the condominiums in my building have decks. All of the decks are in need of repair and replacement. The HOA has decided that it will pay to relace the decks, except for $1,000. Each homeowner with a deck will pay the $1,000. The units without decks will receive a $1,000 credit toward their monthly HOA fees.

It is best to check your governing documents to see if the exterior deck is considered the responsibility of your HOA or the individual unit owners. Your community plat or map should be able to identify if the exterior deck is a common element, a limited common element, or an exclusive common element. Then, the bylaws and CC&Rs should tell you which types of common elements are solely the HOA’s responsibility, which ones are the responsibility of owners, etc.
