Who Is Responsible for Roof Repairs in Illinois?

Our homeowners association is named “Old Town Square” 11 units were built 13 years ago and 7 units were built 3 years ago. All townhomes are 3 stories, but the 11 units have structures on top of their units that house a laundry facility. The 2 of the 11 units are starting to leak water. As a board we are wondering who is responsible for the repairs of this roof? We have limited funds as the board is new because we took if over from the builder of these units last year. Can we have the individual owners be responsible for their own roofs? Can we vote on this as a board?

It is important to check your governing documents. Your community plat should be able to tell you which parts of the structure are considered common elements, limited common elements, and exclusive common elements. Then, your CC&Rs or declaration should indicate who is responsible for maintaining and repairing each element.
