Young Resident in 50+ Community in WA

Question:

Hello! I had a general question about homeowner rights regarding guests in a senior living community.

If I live in a 50+ community and my daughter who is under the age of 50 visits me and stays with me is the HOA allowed to ban/trespass my child? I believe in Washington, younger people can live in these communities and purchase homes there too.

Is there a way I can disagree with their decision or what can I do to try and fight for my right? I am unable to spend holidays with her in my home or have dinner with her anymore. It’s not right.

Typically, a younger person can purchase a home and live in a 50+ community as long as there is at least one person in the household who is 50 and older. However, it will ultimately depend on your HOA’s guidelines. Some HOAs allow it, while others only allow guests for a certain number of days. If your HOA doesn’t allow this, talk to your HOA board to see what you can do. But it’s important to understand that HOAs do generally have the authority to impose such rules. And by buying a home in the HOA, you agree to abide by those rules.
