Are ARC Meetings Public?

    We reside within a single-family homeowners’ association (HOA) in Florida. I have searched through Florida’s statutes, but I couldn’t locate the answer. Are Architectural Review Committees (ARCs) obligated to conduct public meetings?

    Is your HOA governed by Florida Statutes 720?

    According to FS 720.303(2)(a), ARC meetings where a vote on approval or disapproval occurs must be accessible to owners, and notice of the ARC meeting must be provided. I vaguely recalled that Florida mandates ARC meetings to be open to owners.

    Yes, @nychrisjohn is correct. If ARC requests are subject to review and votes (e.g., approvals or denials), the meeting must be publicly posted in advance and accessible to members. Moreover, there’s an obligation to individually notify any member whose ARC request will be scrutinized during that session.

    If no such review is scheduled, then the ARC committee meeting may be held privately.
