board election results

    We recently had our elections. We had only two candidates for one position. The losing candidate is now asking for all the details of the results, not only who won and who lost. Here is his request verbatim:

    “Can you share the results with ALL property owners and ALL candidates? This would be very basic information that has been withheld from property owners. I am also requesting the number of properties, the number of electronic votes, and the number of proxies sent into” the management company.

    Our management company is saying we cannot share the details he is looking for with everyone, and if he would like to see them, he can request to see them, but he cannot share them with anyone else.

    Several on the board disagree that these details cannot be shared with all. We want to be a transparent as possible. I am unable to find anything in our governing docs or the Texas Property Code that might apply to this situation.

    Does anyone have any experience with this type of situation?

    My thoughts:
    The Board is entitled to the information from the management company upon request but it would be best to only ask for the vote count, not the individual names or how they voted. For instance: 29 votes for John Doe; 33 votes for Jane Doe; 10 votes for Bob Smith. This info can certainly be shared with the owners and should be reflected in the Minutes following the election.

    Hi Liz,

    I agree with Nancy. I don’t think it is wise to share the names of the homeowners who voted for which candidate. This can create tension among members of the community. It can trigger conflict and fights.

    You may also want to check your bylaws and CC&Rs to see if your board has the authority to even share the detailed results with homeowners.
