Developer taken over board and won’t spend money

    Our HOA BOARD FOR ALL PRACTICAL PURPOSES HAS DISSOLVED AND NO LONGER HOLDS MEETINGS. THE SUB-DIVISION DEVELOPER CONTROLS THE HOA’S MONEY, ABOUT $350K, AND SPENDS LITTLE MONEY MAINTAINING THE COMMONS AREA NOR ENFORCING RULES. PRIOR HOA BOARD MEETING HAVE USUALLY ENDED UP AS NOTHING MORE THAN SHOUTING MATCHES BETWEEN THE DEVELOPER AND BOARD MEMBERS AND/OR HOMEOWNERS. WHAT SOULD OR COULD BE DONE?

    Turn to your governing documents. Your bylaws and CC&Rs likely dictate the enforcement and maintenance obligations of the HOA/developer. If this is not followed, you may want to look into taking legal action to compel the HOA to act.

    Why did your board dissolve in the first place? If your HOA should be under homeowner control, then your developer should not be in charge anymore. Get a proper board.
