I just moved in with my great aunt who is almost 80 years old and cannot take care of herself (she is bedridden). The HOA is telling me I can’t live her because it’s a senior community and I’m not on the deed. Is this legal? Who is going to take care of my aunt? I cannot afford a nursing home and neither can she. This is just absurd. Isn’t this discriminatory?

55-and-over communities are the exception to fair housing laws. BUT since your aunt meets the age requirement, I think you should be able to live there. In my experience, 55-and-over communities require at least one household member to be over the aged of 55.

craigp_77 is correct. That is generally how senior communities work. The HOA can’t kick out a husband and wife couple if the husband is the only senior one there. This is only an example. However, your situation is also a good example.

I’d lawyer up if I were you. Don’t let your HOA bully you. Fight back. You have rights.
