Theft By HOA AND ATTY

    I am a disabled senior citizen through a governmental program I obtained funds to pay my HOA dues typically the Dos were split between you could pay half the fees for the 1st 6 months and the second half in the second half of the year. The agency got the full payment to the HOA in June of the year 2023. I was fine for being late for the full year. And then there was an excess of $1,000 roughly over the dues and fines. I have an email between the HOA office and the HOA attorney where they are discussing what to do with the excessive funds the attorney tells the office that he will take care of it and we’ll make a spreadsheet accounting for those funds being paid directly to him. With the heading for that payment referred to as future expenses. On the spreadsheet
    I have not seen or heard or nobody has told me why they would have taken that money for future expenses and what that really means towards the HOA and not towards the agency that gave it to me to be used for my expenses.

    If the agency paid the check to the homeowners association (or their attorney on behalf of the HOA), then they’re not required to disperse those funds to you unless there was something in the agreement or terms from the agency. The future expenses simply means you have a credit on your HOA balance now. As dues are charged in the future, those excess funds will be used for those dues.

    Contact a representative of the program and inform them that the HOA and the attorney are discussing what to do with the excessive payments. Ask that they look into it and make any corrections necessary. Any overpayments should be a credit on the owners ledgers balance, or refunded to the payer.
