Board Member Sends Mail Back Without Permission

Hello,

The director of the board of my HOA has now on multiple occasions taken my packages from the mail area and had them sent back to sender because my packages were not picked up in what she deemed a ‘timely’ manner. There is no stipulation in our HOA CC&Rs or rules and regulations that states this as a rule or as an acceptable consequence, and as I understand it, taking my packages and sending them back constitutes federal mail tampering. I’d like to know what action I can take against the board member who continues to do this illegal activity without there being a published rule allowing her to do so.

Hi Tara,

If there is no such rule in your HOA requiring owners to pick up their packages within a certain timeframe, bring this to the attention of your HOA board. Explain to them that a board member has been enforcing a non-existent rule. It may also constitute mail tampering, which includes withholding mail from someone else.

If the board member continues to enforce a non-existent rule, you may want to consider removing them from the board.
