Disabled Parking in California Condominium

Question:

I am a home owner in a condo conversation community. For as long as these buildings have been here( since the 60s), there has been designated disable parking spaces. Recently, the HOA board decided to re asign one of the spaces, citing that as a private property they do not have to legaly provide disable parking. Is this legal? We have disable homeowners that use and rely on those spaces wich are closer to the entrance.

Answer:

Hi Eduardo,

As per the Fair Housing Act (FHA), residential associations are required to reasonably accommodate a disabled resident’s request for special parking.
