Dissolving an HOA in Mississippi

Question:

What is the process for dissolving an HOA and how to file the proper documents.

– Carl

Answer:

Hi Carl,

If your HOA is organized as a nonprofit corporation, as most HOAs in Mississippi are, you may dissolve the association by submitting the articles of dissolution to the Secretary of State as provided in Section 79-11-337 of the Mississippi Nonprofit Corporation Act. Keep in mind that you may need to fulfill other requirements prior to the dissolution, such as securing a majority vote of approval from the membership, depending on your HOA’s governing documents.
