HOA Not Paying a Contractor Resulting in a Lien

Question:

My apartment flooded in March, the contractor completed work on or about April 1. The arrangement is that I pay for the first 10K in costs, and the HOA pays the rest. My contractor STILL has not been paid for the work and I am now faced with having a mechanic’s lien filed against my property bc the HOA will not pay the contractor- can I file a complaint against my HOA? or a lien against the entire building? or something to get them to pay the contractor? I am quite sure their insurance company has issued a check to the HOA already, they just will not release the funds…

Kindly review the contract between the HOA and the contractor to verify who pays the amount and what the terms are. If the HOA is liable, raise this up with the HOA board or file a complaint. You may also consult a lawyer for further assistance.
