Renting Basements in Maryland

Question:

In my HOA by-laws, it says that I can rent my property. However, the HOA by law does not state word for word that I cannot rent my basement-which has an egress window bedroom and separate entrance. I was told verbally by the HOA president that I cannot rent my basement because it is partitioned and that if I want to rent, I can only rent my entire house contingent on the HOA’s approval.

Do I have any rights as an HOA resident?

It depends on the language used in your bylaws. Many homeowners associations do have the ability to restrict rentals and even approve/deny rental applications. It is best to ask a lawyer to take a look at your bylaws for a legal interpretation of the rental provisions.
