Restricting Subletting in Oregon HOA

Question:

I want to amend a lease policy. For our HOA. I want to make it so that a lessee is not allowed to rent out room mates. Keeping it only for Family, care givers and overnight guests. Does Oregon allow me to do that. I want the power to evict if a lessee violates without care the rules and covenant of our CCR. Or due to housing shortage does Oregon not allow such a thing

Hi Kelly,

Generally, an HOA can amend its documents to restrict subleasing or subletting. An HOA may require that homeowners include a term in the rental or lease agreement that prohibits a tenant from subleasing or subletting the unit or home. In doing so, if a tenant breaks the terms of the agreement by subleasing or subletting, the landlord/homeowner would have grounds to evict them. Consult a lawyer for further guidance.
