    One owner threatened to, but once we showed we followed proper amendment procedure and involved legal counsel, they dropped it. If your vote threshold is high, maybe start with a moratorium or trial restriction first, then push for a formal amendment once people see the benefits.

    We went through something similar two years ago. “Residential use” can be interpreted in different ways, so we had to amend our declaration to make the ban clear. Our attorney advised that anything not explicitly stated in the governing documents would be hard to enforce in court. You’ll likely need a formal amendment, which in our case required 67% approval.

    Agreed, especially about getting legal advice. When we updated ours, we also made sure to get community input through a survey. This helped minimize pushback when we enforced the new standards. Make sure your design review board is well-versed in the new guidelines so there’s consistent interpretation when approving or rejecting applications.

    It is NEVER a good idea for homeowners to stop paying their dues as a way to control or get revenge on the HOA. Homeowners will only suffer the consequences of nonpayment, and you can end up losing your home. If you’re really concerned, you might want to consider removing the board members and replacing them with more effective people.

    I agree with the above response. It is likely that you cannot ban these homeowners from voting just because they don’t live there. However, I know of some HOAs that have rules saying only homeowners who live in the community can run for the board. I’m not sure if that’s related at all to your concern but just my two cents.

    Lawyers generally don’t recommend communities to use social media. Sure it’s convenient and great for communicating but it also has a lotta pitfalls as mentioned by others here

    Just based on personal experience with HOA’s, I think that they can do that but I agree that it’s definitely infuriating. $1500 is not a small amount.
