    I am not sure how old this post is regarding capital contribution. In my experience this is paid at settlement and the title company pay the HOA. The governing documents address the capital contribution and it is paid by the purchaser of a home. Most buyers do not question this charge. The HOA determines how the funds are to be used. I am on the finance committee for our HOA and we are no longer including this as a budget item as it is a guess on how many homes would be sold in any year. Our CC is currently $750 and we are looking to increase it to $2,000. We surveyed approximately 30 communities in our area and this is the charge by most. This requires a change to the governing documents and a vote by the community with 66.67% in favor of this change. We are wording the change to tie it to 9 months of the monthly assessments. As assessments increase, the capital contribution would increase and no need to update the governing documents in the future.

    I just had a discussion with a neighbor and his wife, who both were police officers, regarding this issue as our community is looking into getting cameras. Their concern with cameras on the playground is who has access to the footage? Has those individuals had a background check and if the State allows it registered? Similar to teachers and daycare workers.

    I personally do not like floor nominations. The other candidates have filed timely with the HOA that they are running for election and provide information on their reason for seeking to be on the Board with their bio. This allows the community to review their info and decide if this is the person they wish to elect. A person being nominated from the floor, last minute, does not give members enough information to make an informed decision.

    We recently had this happen at the annual meeting. It was obviously a coordinated effort as the candidate had a bunch of people lined up to vote for him and I believe that a number of the proxies were changed to vote for him. The entire Board had elected not to run for the 2024 term and he was one of the Board members.

    The DE Uniform Common Interest Community code does not include any reference for floor nominations not does Roberts Rules of Order. I want to ensure this does not happen again. How can we prevent this scheme?

    Income from renting facilities would be taxable income.

    Easy answer is no. You need to review the policy for the rating basis of the General Liability. There should be a classification for 45523 – Lakes and it would list the number of ponds that you have.
