    First, make sure to let your BOD know that your bylaws say this. Read through your bylaws to confirm that there are no other provisions that give your BOD the power to delay or forgo the vacancy filling. Violating the bylaws could be construed as a violation of the BOD’s fiduciary duty.

    Unfortunately, if you want to meet you reserve requirement, you have no other choice but to levy a special assessment or raise dues by a significant amount. Homeowners associations secure their funding through homeowner dues and assessments. There’s really nowhere else you can get the money from realistically. A bank loan would solve your problem temporarily, but then you would have the loan to pay off. That would still require you to charge a special assessment or raise dues. I suppose you could try fundraising alternatives, but who else would you get those funds from? Again, it’s the homeowners. Sorry to say it, but you’re out of luck here.

    Associations can plan events and invite even non-members of the community. This might be a way your condo is raising funds, too. If you don’t have a lot of kids in your condo, an Easter event that’s open to the public would make more sense.

    Although citing laws and all is great you don’t have a lot of options if your builder simply refuses to follolw them. Try showing them these laws but if they still don’t budge then you might need to sue. I know it’s not ideal since itwill take time and cost money but if you’re really unsatisfied you might wanna consider it.

    Budget deficits definitely need to be looked into if it happens often. Odds are something’s not right internally. Let me know how that works out for you!

    We do it at our HOA, and it’s a good way to get some extra cash flow. But I do recommend only allowing residents to rent out the facilities instead of opening it up to the general public. This is because you don’t really have much control over the public and can’t penalize them in the same way as you can with your own residents.

    What’s causing your budget deficit? Are there too many owners not paying their fees? Perhaps this is a larger problem when you dig deeper and not something you can fix by simply hiring a financial management firm.

    Considering you have 300 units in your HOA, I think the decision to fire your management company was a bad one. You’ll quickly find that financial management is not the only thing you’re gonna have a hard time with over the next year or so. I suggest you hire another management company but maybe look for one that your budget can afford.

    I live in a 250-unit condominium and we’ve been self-managed for three years now. We had a management company before that (I won’t name names) and it was utterly horrible. They mismanaged funds and overcharged us. They also didn’t really do much – just a lot of paperwork but the board ultimately did everything else. For us, it just wasn’t worth it. I’d recommend skipping it and going self-managed instead. If you have the right board members, it should be easy.

    If your bylaws don’t allow it, you can call the board’s attention and maybe recall one of them. A similar incident happened in our HOA but with committees. We had to remove one of the spouses from the fining committee because our bylaws don’t allow it.

    It is not unreasonable to think that your CC&R’s may in fact be outdated, especially if it was written a long time ago. I think the problem here is that your board failed to follow proper procedures and instead took a shortcut. If they want to go against the CC&R’s, then they should take the proper steps to amend them first.
