Gov. Jay Inslee has signed House Bill 1043, a law that streamlines the rules and regulations in common interest communities.

 

House Bill 1043: New Law Passed in Washington

Sponsored by state Rep. Joel McEntire, House Bill 1043 received Gov. Jay Inslee’s signature after passing the Legislature. The bill addresses several concerns that McEntire’s constituents raised about common interest communities.

Several statutes govern common interest communities in the state. The bill aims to provide some consistency regarding these statutes, their regulations, and how they apply to communities.

In particular, the new law helps communities conduct fair and balanced elections. It also tackles record-keeping requirements for lists of unit owners.

The bill amends the Washington Homeowners Association Act, the Washington Condominium Act, and the Washington Horizontal Property Regimes Act to be more consistent with the Washington Uniform Common Interest Ownership Act (WUCIOA). However, the bill also makes amendments to the latter regarding record-keeping requirements and withholding requirements for certain association records.

Another bill, House Bill 1782, also received Gov. Inslee’s signature simultaneously. HB 1782, though, tackles the operation of the Wahkiakum County ferry. It does not affect homeowners associations in Washington.

HB 1043 is set to take effect on July 22, 2023.
