Biggest downside? Some people now feel even more disconnected from the HOA. Attendance at board meetings dropped once we moved them online. If you switch, make sure you still engage the community in other ways.

That sounds super shady. HOAs are supposed to follow their rules consistently. Have you asked to see the approval paperwork for your neighbor’s fence?

Ugh, I feel you. My HOA did this a few years ago. Turned out they had some insurance issue, so they banned grilling to avoid “liability.” Maybe check if that’s the case?

In our community, we found that creating a suggestion box allowed homeowners to express concerns without disrupting meetings. It gave us a chance to address issues more thoughtfully and maintain a positive atmosphere during meetings.

I feel your pain. HOAs can be tricky. Maybe try attending an HOA meeting and voicing your concerns directly? Sometimes they respond better when faced with a group of concerned homeowners.

In this case, I would advise you not to sue. It looks like your declaration is pretty vague on tall fences by not defining what constitutes tall. As I said before, your board generally has discretion over how to interpret tall. You might not have a case.

Does it say anything else about fences? Some vague or general guidelines may be a source of misinterpretation. The board usually has discretion over how to interpret them.

Before you sue, I advise you to get your lawyer to examine your case first and see if you have a fighting chance. What exactly are the fines for? How are you sure you’re in the right?

They have been harassing me nonstop for a “violation” but I didnt violate crap. I parked my truck in my driveway and they said it shouldnt be there but I cant even find the rule that says I cant do that. They say I owe $600dollars but they aint got no proof for it.

We pay our manager on a per-door basis… so that’s $100 per door and we have like 200 doors… so that’s $20,000 a year easy. That gives us a few on-site inspections per year, 100% administrative work outsourced, paperwork handling, and they attend 4 meetings out of the year.

Again, it’s probably because you didn’t get permission or go through the correct application process. Honestly, it’s not that hard to fill out a few forms and wait for your board to give their approval.

I really don’t think suing the HOA is the answer here. That will only create mroe problems and drag your innocent neighbors into the problem. Who do you think will have to cover the monetary damages if you win? That’s right – everyone else. Suing is a surefire way to get yourself on your neighbors’ bad side. I strongly advise against it.

You may not like your HOA’s rules but that does not make them invalid. Fair warning – if you don’t take down your cameras as your HOA asked then you might face some penalties.

Security cameras may not be explicitly stated in your governing documents, but they might fall under your HOA’s architectural guidelines. If the cameras are on your exterior, then your HOA board and architectural committee likely has authority over them. It could be considered an external change. Thus, because you installed them without permission, the HOA has the right to ask you to remove them and go through the proper application process.
