    We have brought this to the attention of the HOA several months ago. I am not asking for overnight results. Do not comment on things you don’t know.

    I am aware that suing is not always good. But I feel that I have been left with no choice at this point. Several of my neighbors and I are suffering because of these roads and it is unfair that we pay dues that go to nothing.

    Check your Colorado laws. I’m not very familiar with them. You might also want to ask a lawyer for advice.

    Shemco is right. Check your state laws. The laws on privacy when it comes to HOA records and documents aren’t very clear-cut or black and white. For instance, here in California, the law allows members to request a copy of the membership list, which can include the email addresses of the owners. But, members must state the purpose of the request, and the board can deny a member’s request for this list if the board believes it will be misused by the member.

    A transfer fee does serve a purpose. Perhaps your HOA found that it was incurring costs every time someone new moved into the community so they decided to charge a fee. This usually covers things like printing and mailing costs for the declaration and bylaws, handbooks, etc. I understand you’re mad OP, but the fee is necessary. Someone somewhere just made a mistake about not letting you know before you purchased the home. Just be glad it’s only a one-time fee and that your HOA doesn’t charge an exorbitant amount like many others.

    You can check your historical records to see how many withdrawals you average a year. That should give you an idea of how often you will need the treasurer (and perhaps another signatory) to sign checks. Based on personal experience, though, two signatories is a good internal control. But if it’s not possible for your Board, maybe you could just check your accounts and reconcile everything more often.

    It really depends on what your declaration says. Ours say we cant pay our board members so we dont.
